These Terms & Conditions (“Terms”) govern your use of Factory’s website, platform, and services (together, the “Services”). By applying for a website, creating an account, or using the Services, you agree to these Terms.

The service

Factory designs, builds, and hosts websites for local businesses, and provides an accompanying platform that may include lead capture, booking tools, messaging, analytics, and editing tools. Website creation is provided at no upfront cost; hosting and platform tools are provided under a monthly subscription plan selected during signup.

Accounts & eligibility

• You must be at least 18 years old and authorized to act on behalf of your business.
• You are responsible for the accuracy of the information you provide and for activity on your account.
• Keep your login credentials (including sign-in codes emailed to you) confidential.

Your content

You retain ownership of the content you provide (photos, logos, business information). You grant us a license to host, display, and adapt that content as needed to build and operate your website. You confirm you have the rights to any content you provide and that it does not infringe on anyone else’s rights.

Our materials

The design systems, software, templates, and tools used to build and operate your website remain the property of Factory. While your subscription is active, you have the right to use them as part of your website and the Services.

Billing

• Paid plans are billed monthly to the payment method you provide, starting when your website is published (including any free-trial period we offer).
• You can cancel at any time; cancellation takes effect at the end of the current billing period.
• If a payment fails, your website stays online, but platform tools may be paused until billing is resolved.

Acceptable use

You may not use the Services for anything unlawful, deceptive, or harmful — including spam, infringing content, or interfering with the operation or security of the platform. We may suspend or terminate Services that violate these Terms.

SMS messaging terms

Factoryoffers SMS notifications to customers who opt in — for example, updates about your application or account, and alerts when a new customer lead comes in from your website (“FactoryNotifications”). By opting in, you agree to the following:

• Message frequency varies based on your account activity (for example, one message per new customer lead).
• Message and data rates may apply. Check with your mobile carrier for details.
• Opt out any time by replying STOP to any message. You will receive a final confirmation message, after which no further messages will be sent.
• Need help? Reply HELP to any message or email support@trywebfactory.com.
• Consent to receive text messages is not a condition of purchasing any service.
• Wireless carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your mobile carrier.
• Mobile numbers and SMS opt-in data are never shared with third parties for marketing purposes — see our Privacy Policy.

Disclaimers

The Services are provided “as is.” We work hard to keep your website fast, secure, and online, but we do not guarantee uninterrupted availability, specific search rankings, or specific business results (such as lead volume or revenue).

Limitation of liability

To the maximum extent permitted by law, Factory’s total liability for any claim arising out of the Services is limited to the amount you paid us in the three (3) months before the claim arose. We are not liable for indirect, incidental, or consequential damages.

Termination

You may cancel at any time. We may suspend or terminate the Services for violation of these Terms or non-payment. Upon termination, we will make reasonable efforts to let you export the content you provided.

Changes & governing law

We may update these Terms from time to time; the current version will always be posted on this page with its effective date. These Terms are governed by the laws of Canada.
